Cross-border disputes stand apart from ordinary domestic cases. They frequently require the court to apply foreign law and, almost always, task the judge with assessing factual circumstances that took place in another country in the context of a different culture and unfamiliar business practices. A cross-border dispute may involve several parallel proceedings that need to be coordinated so that something said in one set of proceedings (or even commencement of these proceedings) does not undermine the entire case.
Sergey Usoskin has significant experience advising clients on cross-border disputes before the courts of various jurisdictions including England, France, Germany, Cyprus, Italy, Pakistan and the US. Important questions of interpretation and application of Russian law frequently arose in these cases and Sergey is well-accustomed to instructing Russian law experts and liaising with foreign counsel in this respect. He also coordinated evidence-gathering exercises, in particular, in the context of disclosure and discovery processes.
